Dominican Republic Labor Benefits Calculator

Dominican Republic · Employment

Estimate your labor benefits in the Dominican Republic: notice period, severance pay, vacation, and prorated Christmas salary, based on the reason the contract ended. Follows the methodology of the official Ministry of Labor calculator for private-sector salaried workers.

Changes the result: notice period and severance pay don't apply to every termination.

Ordinary salary plus regular commissions, at the frequency you choose (excluding overtime and benefits).

Las vacaciones se valoran con el último salario del período. 0 = igual al salario indicado.

How is it calculated?

Benefits are calculated with the average daily salary: the period's ordinary salary (including regular commissions), averaged over the last 12 months (or months worked), divided by 23.83 days per month (11.91 biweekly, 5.5 weekly, 1 daily). Notice period (Art. 76 and 79): 7 days with 3 to 6 months of service, 14 with 6 to 12 months, and 28 with one year or more; paid as substitute compensation only if notice wasn't given. Severance pay (Art. 80): 6 days with 3 to 6 months, 13 with 6 to 12 months, 21 days per year between 1 and 5 years, and 23 days per year with 5 years or more; a year's fraction is paid with 6 days (3 to 6 months) or 13 days (6 to 11 months). Vacation (Art. 177 to 182): 14 working days between 1 and 5 years and 18 with 5 years or more; with less than a year, or if last year's vacation was already taken, the prorated fraction of 6 to 12 days by months; valued with the last salary. Christmas salary (Art. 219 and 220): 1/12 of the calendar year's ordinary salary, prorated to the time worked. Notice period and severance pay don't apply to every termination: they depend on the cause (employer's severance notice, unjustified dismissal, or justified resignation do apply; resignation and justified dismissal don't). Notice period and severance pay are exempt from income tax (Art. 86). Results are a rough guide: some protected situations require specific analysis.

Examples

  • Employer's severance notice after 5 years (09/01/2021 to 08/31/2026), monthly salary of 30,000, no notice given

Daily salary 1,258.92. Notice period 28 days: 35,249.69. Severance pay 115 days (23 for 5 years): 144,775.49. Prorated Christmas salary (8 months): 20,000. Estimated total: 200,025.18.

  • Resignation with last year's vacation pending (same case)

No notice period or severance pay due to the cause. Vacation 18 days: 22,660.51 and Christmas salary 20,000. Total: 42,660.51.

Which benefits apply based on the reason for termination

Vacation and the prorated Christmas salary are always paid. The notice period and severance pay only apply to the employer's severance notice, a dismissal declared unjustified, and a justified resignation.
