Dominican Republic Notice Period Calculator
Dominican Republic · EmploymentCalculate the notice period (preaviso) in the Dominican Republic under Article 76 of the Labor Code: 7, 14, or 28 days of salary based on your seniority. Estimates the substitute compensation owed when notice wasn't given or was insufficient.
How is it calculated?
Article 76 scale: with 3 to 6 months of continuous work, 7 days; from 6 months to one year, 14 days; and with one year or more, 28 days. With less than 3 months, no notice period applies. The substitute compensation (Art. 79) equals the pay for those days: days × daily salary. Daily salary is the period's ordinary salary averaged over the last 12 months (or months worked) and divided by 23.83 days per month (11.91 per biweekly period, 5.5 per week, 1 per day), as in the official Ministry of Labor calculator. If notice is properly given and worked through, those days aren't paid as additional compensation: the calculator estimates the substitute payment. The notice period is exempt from income tax (Art. 86) and must be paid within ten days of termination. This is a rough estimate.
Examples
5 years of service, monthly salary of 30,000
28 days × 1,258.92 = 35,249.69.
Exactly 6 months of service
14 days × 1,258.92 = 17,624.84.
How many notice-period days you're owed
The notice period depends on seniority: 7 days with at least 3 months, 14 days with at least 6 months, and 28 days with one year or more.
With more than a year of seniority and a salary of 30,000, the 28-day notice period equals 35,249.69. If it wasn't given, that amount is paid as substitute compensation. Figures are illustrative.
| Seniority | Notice-period days |
|---|---|
| 3 to under 6 months | 7 |
| 6 to under 12 months | 14 |
| 12 months or more | 28 |
Notice period, severance pay, and benefits
