Mexico Unjustified Dismissal Severance Calculator
Mexico · EmploymentWhat could you be owed if you're dismissed? Estimate the final settlement (finiquito), the 3-month constitutional compensation, and the seniority premium that may apply in an unjustified dismissal — and, if it applies to your case, the additional 20-days-per-year scenario. This is a rough estimate: whether each item applies depends on the circumstances of the termination and may require labor law advice (see PROFEDET in the sources).
How is it calculated?
The estimated total adds several independent items that reuse Numelto's final settlement and seniority premium calculators: (1) the final settlement (pending salary, prorated aguinaldo, vacation, and vacation premium — exactly the same calculation as the Mexico Final Settlement calculator); (2) the 3-month constitutional compensation; (3) the seniority premium (12 days of salary per year of service, with the legal cap — exactly the same calculation as the Seniority Premium calculator); and, only if you enable the scenario, (4) 20 days of salary per year of service. This last item does NOT automatically apply to every unjustified dismissal — it depends on the specific circumstances of the case, so it appears disabled by default.
Examples
6 years of seniority, monthly salary of 15,000, 20-days scenario disabled
Final settlement: 340.99. Constitutional compensation (3 months): 45,000.00. Seniority premium: 35,565.98. Estimated total: 80,906.97.
What you may be owed in an unjustified dismissal
Whether a dismissal is unjustified and which items apply is determined by the labor authority or an agreement; this calculator only estimates amounts. PROFEDET offers free advice.
| Item | What it is |
|---|---|
| Final settlement (finiquito) | Benefits already earned: pending salary, prorated aguinaldo, vacation, and vacation premium. Always paid. |
| Constitutional compensation | Three months of salary. |
| Seniority premium | 12 days of salary per year of service, with the legal cap. |
| 20 days per year | Only in certain cases, depending on the dismissal's circumstances; disabled by default. |
Calculation example
