Mexico Seniority Premium Calculator
Mexico · EmploymentCalculate how much seniority premium you're owed: 12 days of salary for each year of service, with the applicable legal cap and the special rule when the termination is a voluntary resignation.
How is it calculated?
The seniority premium is 12 days of salary for each year of service (prorated if the last year is incomplete), calculated on your daily salary or, if it exceeds it, on the legal cap — twice the minimum wage for your zone, per PROFEDET's reference criterion. If the termination was a voluntary resignation, the general rule requires at least 15 years of service for this right to apply; dismissal or separation doesn't have that minimum.
Examples
Dismissal with 8 years of service, daily salary of 300
You're owed 96 days of seniority premium — 28,800.00.
Resignation with 10 years of service (doesn't meet the minimum)
No seniority premium applies: a voluntary resignation requires at least 15 years of service.
When the seniority premium applies
It's 12 days of salary per year of service, prorated if the last year was incomplete, calculated on your daily salary or, if it exceeds it, on the cap: twice the minimum wage for your zone (630.08 daily in the general zone).
| Type of termination | Does it apply? |
|---|---|
| Dismissal or separation | Yes, with no minimum years |
| Voluntary resignation | Only with at least 15 years of service |
Examples
Dismissal with 8 years of service and a daily salary of 300: 96 days, that is, 28,800.00. Resignation with 10 years: no seniority premium applies, a voluntary resignation requires at least 15 years of service. Illustrative figures. The premium is part of the severance for unjustified dismissal; payment of what's already earned is in the final settlement.
