Spain Severance Pay Calculator
Spain · MoneyEstimate the legal severance pay for a dismissal in Spain depending on the type: unfair dismissal (33 days/year, or the transitional regime for contracts starting before 2012), fair/objective dismissal (20 days/year), or the end of a temporary contract (12 days/year).
How is it calculated?
Severance is calculated as days of salary per year worked, depending on the dismissal type: 33 days/year for unfair dismissal (capped at 24 monthly payments), 20 days/year for an objective or fair dismissal due to economic, technical, organizational or production reasons (capped at 12 monthly payments), and 12 days/year when a temporary contract ends. If your contract started before February 12, 2012 and the dismissal is unfair, Spain's transitional rule (Estatuto de los Trabajadores) applies: 45 days/year for the period worked before that date and 33 days/year for the period after, capped at 24 monthly payments (or 42 if the pre-2012 period alone already exceeds that). Daily salary is the monthly gross salary divided by 30.
Examples
Unfair dismissal, 3 years worked, 2022 contract
3 years × 33 days/year = 99 days × (€1,800/30) = €5,940.
Fair dismissal for economic reasons, 5 years worked
5 years × 20 days/year = 100 days × (€1,500/30) = €5,000.
Unfair dismissal with a pre-2012 contract
2 years at 45 days/year (until Feb 2012) plus 12 years 11 months at 33 days/year — the transitional rule applies.
