Colombia Dismissal Without Just Cause Compensation Calculator
Colombia · EmploymentEstimate the compensation owed for dismissal without just cause in Colombia based on your contract type, salary, and time worked. This is a rough estimate: it doesn't include your social benefits (that's the final settlement) and some cases, like reinforced job stability, require legal analysis and can change the result.
This compensation doesn't include your social benefits or vacation. Also calculate your final settlement →
How is it calculated?
Compensation under Article 64 of the Substantive Labor Code depends on the contract. Indefinite-term with a salary under 10 SMLMV: 30 days of salary for the first year and 20 days for each additional year, prorated for fractions. Indefinite-term with 10 SMLMV or more (17,509,050 in 2026): 20 days for the first year and 15 for each additional year. Fixed-term: the salary corresponding to the time remaining until the contract's end. Project or task contract: the salary for the time remaining, with a minimum of 15 days. Each day is paid at monthly salary ÷ 30. It doesn't include severance pay, service bonus, or vacation: those are calculated separately in the final settlement.
Examples
Indefinite-term contract, salary of 3,000,000, three years
30 days for the first year + 40 days for the two additional years = 70 days. Compensation: 7,000,000.
Fixed-term contract, salary of 3,000,000, ended June 30, 2026 (was due to end December 31)
180 days remained on the contract. Compensation: 18,000,000.
Indefinite-term contract with a salary of 20,000,000 (more than 10 SMLMV), three years
20 days for the first year + 30 days for the two additional years = 50 days. Compensation: 33,333,333.
Project/task contract with only 5 days remaining
The legal minimum of 15 days applies. Compensation: 1,500,000.
How it's calculated by contract type
For an indefinite-term contract with a salary under 10 SMLMV, it's 30 days of salary for the first year and 20 for each additional year; for a fixed-term contract, the salary for the time remaining.
Each day is paid at monthly salary ÷ 30, and fractions of a year are prorated.
